USCIS to Implement Final Phase of Premium Processing Expansion for EB-1C and EB-2 NIW Form I-140 Petition 

The U.S. Citizenship and Immigration Services (USCIS) announced that on January 30, 2023, it will implement premium processing for Form I-140 new (initial) petitions under the EB-1C and EB-2 NIW classifications. USCIS will also continue to offer premium processing to all previously filed Form I-140 petitions under an E13 multinational executive and manager classification (EB-1C) or E21 classification as a member of professions with advanced degrees or exceptional ability seeking a national interest waiver (EB-2 NIW). 

In the coming months, USCIS also anticipates expanding premium processing services for certain F-1 students who have a new or pending Form I-765, Application for Employment Authorization (EAD) and Form I-539, Application to Extend/Change Nonimmigrant Status. 

With this announcement, F-1 students will have an avenue to avoid USCIS backlogs and expedite their EAD work authorizations and their Form I-539 applications so that they do not experience a gap in employment.
